Terms & Conditions

The following terms of use apply to all orders placed by the customer (hereinafter referred to as “you”, “buyer” or “buyers”) with Antonio Fazio hereinafter referred to as “ARCHYVIO”, “us” or “we”, at www.archyvio.com.

By using www.archyvio.com and/or placing an order, you agree to be bound by the terms of use set out herein. Please make sure you have read and understood the Terms before placing your order. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the site.

Prices

The prices stated are expressed in EUROS (EUR/€). These prices include shipping fee, any other taxes to be paid by the Buyer. We reserve the right to amend these prices at any time.

The prices displayed at www.archyvio.com are final prices. Invoicing is made in accordance with Swiss tax law.

Buyer is responsible for any customs charges that may be applied to his package.

Conclusion of Contract

To place an order with us, you can purchase your selected item(s) directly from our website (A), or send an inquiry to contact@archyvio.com (B). Orders can be placed on our website 7 days a week.

A. The purchase offer is made by the buyer when sending the order using direct payment with STRIPE (www.stripe.com), which we accept by sending back a confirmation email. The receipt of the order confirmation email constitutes acceptance of your order and your agreement to these terms and conditions.

B. The offer to purchase can also be made by sending an inquiry using contact@archyvio.com. Once agreement is reached between “us” and the “buyer”, we will then send an invoice by email using STRIPE to place the order. The order is considered as complete once payment in full is received on our account.

We reserve the right to refuse any purchase offer made by the Buyer at our sole discretion, in particular in the event that the good(s) ordered are sold out, or if its condition doesn’t match the description stated on our website.

If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment.

Please consider that all sales are final, and returns are not possible.

Payment

We only accept payments using STRIPE, a secured payment platform (www.stripe.com). Once the payment method is selected, you can proceed to your order payment on the secured interface, which will formalise the sales contract with “us” in a firm and final manner.

Only after payment has been received in full by “us”, a confirmation e-mail will then be sent to the email address that you rightly provided at registration. A second e-mail will be sent once the order is sent.

You are obliged to submit a correct email address and to inform “us” if your email address changes.

The goods shall remain our  property until full payment has been received.

Shipping

The shipping cost is included in the price stated on the website. We will ship your order using different shippers depending on destination, object size and value. Parcels will be shipped using Economy service with tracking number.

If the Buyer requires a faster shipping option, please contact us at inquiries@archyvio.com, so we can send you an accurate quote, this cost will be covered by the Buyer. The package will be shipped once the payment has been received in full.

We will only ship to the address provided on our website when confirming the purchase.

For now we will only ship to the countries listed here below:

      - USA
      - Canada
      - UK
      - EU (European Union)
      - Switzerland
      - Japan

We do not guarantee shipment time, or quality of any third party services engaged by us on behalf of the Buyer. Please note that delays don’t allow any order cancellation or refund.

We are not liable for any damages or loss sustained in transit via third parties.

Custom Charges

Buyers are responsible for any custom taxes that may be applied to your shipment. Buyers must comply with, and observe all applicable legislations and regulations, including obtaining any relevant import permits needed to purchase goods from us.

Delivery & Return

Buyers are obliged to examine all goods upon delivery. Any defects or damages to the object(s) or packaging incurred during shipping, including delivery errors, must be reported immediately and no later than 48 hours from receipt of delivery.

All complaints must be sent by e-mail to the following address inquiries@archyvio.com, you will need to provide us with a very clear and detailed report of the possible damages, including clear pictures of the object(s) and the packaging (outside/inside). Once received we reserve the right to accept or reject the complaint. In case the complaint is accepted by all parties, we shall then decide to cancel your order and refund the total amount paid. As a result, the object becomes our property again and must be returned to us following the requirements listed on the document we will provide you. Only once the package has been received by “us”, the refund will be made. 

This clause shall not cover damage caused by improper maintenance, or any other improper action taken by the Buyer.

Vintage Objects

We sell vintage objects, vintage items are not sold as new and are likely to have been previously owned. Those objects are sold as is, and therefore cannot be returned or exchanged.

The photographs on our website and social media channels are not contractual, they are here as an illustration and are not a representation of reality. We cannot guarantee all details and colors are depicted realistically and not all condition issues may be photographed or referenced. Any descriptions and statements given, whether orally or in writing, are intended as opinion only and do not constitute a warranty of any kind.

Condition of Use of this Site

By registering on the Site, you agree to be bound by the Terms and Conditions and you warrant to us that: (1) you are of legal age in your country of domicile or have the authority to bind the company you represent to transactions on the Site; (2) the information you provide during the registration process is correct;

Personal Data

Your personal details may only be disclosed to other third parties for the purpose of processing your order (STRIPE* / Transport companies).

We will not willfully disclose any confidential information without your prior permission and your details will not be passed onto a third party for their use in promotional purposes.

Buyers are only added to the newsletter list if they have given their consent by clicking on the associated button in the purchase / contact form. We only send out newsletters after you have given your explicit consent, all subscribers can unsubscribe at any time from us by clicking on the “unsubscribe” link at the top of any email communications which we might send you.

Privacy

We comply with the Swiss data protection legislation and are committed to protecting your privacy. That’s why we’ve chosen Fathom Analytics for our website analytics, which doesn’t use cookies and complies with the GDPR, ePrivacy (including PECR), COPPA and CCPA. Using this privacy-friendly website analytics software, your IP address is only briefly processed, and we (running this website) have no way of identifying you. As per the CCPA, your personal information is de-identified. You can read more about this on Fathom Analytics’ website.

The purpose of us using this software is to understand our website traffic in the most privacy-friendly way possible so that we can continually improve our website and business. The lawful basis as per the GDPR is “f); where our legitimate interests are to improve our website and business continually.” As per the explanation, no personal data is stored over time.

Intellectual Property

The content of the website, including text, logo, graphics, photos, is protected by copyright and is the full and complete property of Archyvio. Any use of this content other than simple consultation of the website without our prior written consent is prohibited.

Any use of the Archyvio trademark in any form or manner whatsoever without our prior written consent is prohibited.

Applicable Law

This privacy policy is governed by Swiss law. Any disputes arising from this or otherwise related to this website will be submitted to the competent court in Lausanne, Switzerland.
